{"id":10213,"date":"2023-10-18T13:47:40","date_gmt":"2023-10-18T13:47:40","guid":{"rendered":"https:\/\/shareperformanceinsight.com\/index.php\/2023\/10\/18\/hong-kong-court-backs-same-sex-married-couples-on-equal-housing-rights\/"},"modified":"2023-10-18T13:47:40","modified_gmt":"2023-10-18T13:47:40","slug":"hong-kong-court-backs-same-sex-married-couples-on-equal-housing-rights","status":"publish","type":"post","link":"https:\/\/shareperformanceinsight.com\/index.php\/2023\/10\/18\/hong-kong-court-backs-same-sex-married-couples-on-equal-housing-rights\/","title":{"rendered":"Hong Kong court backs same-sex married couples on equal housing rights"},"content":{"rendered":"<p class=\"paragraph inline-placeholder\">      A Hong Kong court has dismissed a government bid to deny same-sex married couples the right to rent and own public housing, saying that it was \u201cdiscriminatory in nature\u201d and a complete denial of such couples\u2019 rights.  <\/p>\n<p class=\"paragraph inline-placeholder\">      The ruling by Hong Kong\u2019s Court of Appeal on Tuesday is the latest in a series of legal breakthroughs for gay rights advocates in the global financial hub this year.  <\/p>\n<p class=\"paragraph inline-placeholder\">      The government had challenged two High Court rulings that it was \u201cunconstitutional and unlawful\u201d for the city\u2019s housing authority to exclude same-sex couples who married abroad from public housing.  <\/p>\n<p class=\"paragraph inline-placeholder\">      The appeal involved two cases, one in which the authority had declined to consider a permanent resident\u2019s application to rent a public flat with his husband, because their marriage in Canada was not recognized in Hong Kong.  <\/p>\n<p class=\"paragraph inline-placeholder\">      The other involved a same-sex couple who were denied joint-ownership of a government-subsidized flat by the authority because their marriage in Britain was not recognized in Hong Kong.  <\/p>\n<p class=\"paragraph inline-placeholder\">      Court of Appeal justices Jeremy Poon, Aarif Barma and Thomas Au said in a written judgment that the authority\u2019s treatment of gay married couples was \u201cdiscriminatory in nature\u201d and they should be afforded equal treatment.  <\/p>\n<p class=\"paragraph inline-placeholder\">      \u201cThe differential treatment in the present cases is a more severe form of indirect discrimination than most cases because the criterion is one which same-sex couples can never meet,\u201d the judges said in their ruling.  <\/p>\n<p class=\"paragraph inline-placeholder\">      One of the men involved in the second case, Henry Li, welcomed the ruling in a post on Facebook.  <\/p>\n<p class=\"paragraph inline-placeholder\">      Rights group Hong Kong Marriage Equality also welcomed the decision saying it had made clear \u201cthat discrimination and unequal treatment on the ground of sexual orientation has no place in public policy decisions.\u201d  <\/p>\n<p class=\"paragraph inline-placeholder\">      Hong Kong\u2019s top court in September ruled against same-sex marriage but acknowledged same-sex couples\u2019 need \u201cfor access to an alternative legal framework in order to meet basic social requirements.\u201d  <\/p>\n<p class=\"paragraph inline-placeholder\">      The government was given two years to come up with the framework.  <\/p>\n<p class=\"paragraph inline-placeholder\">      A Hong Kong court in September sided with a married lesbian couple who argued that both women should have parental status over their child born via reciprocal IVF.  <\/p>\n<p class=\"paragraph inline-placeholder\">      Activists in other parts of Asia are watching Hong Kong\u2019s courts in the hope that their rulings could influence campaigns for reform elsewhere.  <\/p>\n\n<div>This post appeared first on cnn.com<\/div>","protected":false},"excerpt":{"rendered":"<p>A Hong Kong court has dismissed a government bid to deny same-sex married couples the right to rent and own public housing, saying that it was \u201cdiscriminatory in nature\u201d and a complete denial of such couples\u2019 rights.
