{"id":10690,"date":"2023-10-26T13:58:37","date_gmt":"2023-10-26T13:58:37","guid":{"rendered":"https:\/\/shareperformanceinsight.com\/index.php\/2023\/10\/26\/japan-court-rules-it-is-unconstitutional-to-require-transgender-sterilization-in-landmark-case\/"},"modified":"2023-10-26T13:58:37","modified_gmt":"2023-10-26T13:58:37","slug":"japan-court-rules-it-is-unconstitutional-to-require-transgender-sterilization-in-landmark-case","status":"publish","type":"post","link":"https:\/\/shareperformanceinsight.com\/index.php\/2023\/10\/26\/japan-court-rules-it-is-unconstitutional-to-require-transgender-sterilization-in-landmark-case\/","title":{"rendered":"Japan court rules it is \u2018unconstitutional\u2019 to require transgender sterilization in landmark case"},"content":{"rendered":"<p class=\"paragraph inline-placeholder\">      Japan\u2019s top court has ruled that a government requirement for transgender people to be sterilized before they could be legally recognized was unconstitutional, in a victory for the country\u2019s LGBTQ community years in the making.  <\/p>\n<p class=\"paragraph inline-placeholder\">      Under a law enacted 20 years ago, transgender individuals who want their identity documents amended must have been diagnosed with \u201cgender identity disorder,\u201d be at least 18 years old, be unmarried and without any underage children.  <\/p>\n<p class=\"paragraph inline-placeholder\">      They must also have genital organs resembling those of the opposite sex, and have no reproductive capacity. That means they must have undergone invasive procedures including sterilization and plastic surgery.  <\/p>\n<p class=\"paragraph inline-placeholder\">      The law has long been decried by rights groups, and previous challenges in court have been struck down \u2013 until this case, brought by a transgender woman who wanted to change her legal gender from male to female without surgery.  <\/p>\n<p class=\"paragraph inline-placeholder\">      The plaintiff argued that years of hormone therapy had already impacted her reproductive capabilities, according to public broadcaster NHK.  <\/p>\n<p class=\"paragraph inline-placeholder\">      Her case had been rejected by a family court and a higher court before arriving at the Supreme Court. On Monday, the court ruled in her favor, declaring that the provision requiring sterilization was \u201cin violation\u201d of the constitution.  <\/p>\n<p class=\"paragraph inline-placeholder\">      \u201cThe restriction of freedom from bodily harm under this provision has become increasingly unnecessary at this point in time and the degree of the restriction has become more serious. Therefore, the provision in question is not necessary and reasonable,\u201d the court said in its ruling.  <\/p>\n<p class=\"paragraph inline-placeholder\">      It added that reproductive rights are \u201cconsidered to be fundamental human rights\u201d under the constitution. \u201cThe fact that they must unwillingly undergo removal of their reproductive capacity in order to match their self-identified sex with their legal sex is a cruel choice,\u201d the judgment said.  <\/p>\n<p class=\"paragraph inline-placeholder\">      The historic decision is only the 12th time since World War II that the Supreme Court has judged a legal provision as unconstitutional, thus forcing Japan\u2019s parliament to review the law, NHK reported.  <\/p>\n<p class=\"paragraph inline-placeholder\">      However, that doesn\u2019t mean the whole law is being changed \u2013 only the provision requiring sterilization.  <\/p>\n<p class=\"paragraph inline-placeholder\">      The Supreme Court declined to rule on the other provision requiring transgender individuals to have genital organs \u201cresembling\u201d the opposite sex, saying it was constitutional. That part of the case will be sent back to a lower court to deliberate, according to Monday\u2019s ruling, which added that the requirement does not \u201cdirectly compel\u201d transgender individuals to undergo surgery.  <\/p>\n<p class=\"paragraph inline-placeholder\">      The ruling was met with mixed reactions \u2013 some praise and celebration within the LGBTQ community, but also concern about the remaining surgical requirements, and about broader societal attitudes.  <\/p>\n<p class=\"paragraph inline-placeholder\">      At a press conference after the ruling, the plaintiff\u2019s lawyer Kazuyuki Minami read a statement from the plaintiff, saying she was \u201cextremely surprised at the unexpected outcome.\u201d  <\/p>\n<p class=\"paragraph inline-placeholder\">      \u201cIt is very regrettable that (my) gender change was not approved by the Grand Chamber of Justice and that the case has been postponed,\u201d she said in the statement \u2013 but added, \u201cI am glad that the outcome of this case will lead to a positive direction.\u201d  <\/p>\n<p class=\"paragraph inline-placeholder\">      The attorney, Minami, added that there are \u201creally very few\u201d judgments that deem existing laws unconstitutional, making this ruling \u201cvery significant.\u201d However, he acknowledged, \u201cit is frustrating that we haven\u2019t reached the best conclusion that (the plaintiff) wants.\u201d  <\/p>\n<p class=\"paragraph inline-placeholder\">      Ken Suzuki, a law professor specializing in LGBTQ issues at Japan\u2019s Meijin University, described the court\u2019s decision as \u201chalf a ruling,\u201d saying members of the community are still waiting for the lower court to decide whether other surgeries will be required to have genitals \u201cresembling\u201d the other sex.  <\/p>\n<p class=\"paragraph inline-placeholder\">      \u201cNonetheless, it gives them hope,\u201d he said, calling it a \u201crevolutionary judgment.\u201d \u201cMany can see how the judges actually have taken a great interest in the topic.\u201d  <\/p>\n<p class=\"paragraph inline-placeholder\">      The National Coalition for the Establishment of Laws for Persons with Difficulties Due to Sexual Orientation and Gender Identity, also known as the LGBT Law Coalition, also applauded the decision \u2013 while saying it hoped the Supreme Court would make a \u201cfair decision\u201d on the remaining requirements for transgender individuals.  <\/p>\n<p class=\"paragraph inline-placeholder\">      The organization also expressed \u201cstrong regret\u201d over recent discriminatory incidents against transgender individuals, including widespread \u201canxiety and fear\u201d over transgender individuals using their bathrooms of choice.  <\/p>\n<p class=\"paragraph inline-placeholder\">      Earlier this summer, the Supreme Court ruled against a government agency that had barred a transgender employee from using the women\u2019s bathroom \u2013 its first ruling involving the rights of sexual minorities in the workplace, according to NHK.  <\/p>\n<p class=\"paragraph inline-placeholder\">      Much of Japan has long held\u00a0conservative views\u00a0toward LGBTQ issues \u2013 and while polls in recent years have suggested attitudes are shifting, activists say\u00a0discrimination is still rife. For instance, Japan is the only Group of Seven (G7) nation with no legal protection for same-sex unions.  <\/p>\n<p class=\"paragraph inline-placeholder\">      This spring the government came under increasing pressure to pass a law promoting understanding of the LGBTQ community, ahead of hosting the G7 leaders\u2019 summit in May \u2013 but wrangling over the bill meant it was only submitted to parliament the day before the summit began.  <\/p>\n<p class=\"paragraph inline-placeholder\">      In the end, the bill that passed was a watered-down version of what activists had hoped for, with no human rights guarantees provided \u2013 and even wording that may tacitly encourage some forms of discrimination, critics say.  <\/p>\n\n<div>This post appeared first on cnn.com<\/div>","protected":false},"excerpt":{"rendered":"<p>Japan\u2019s top court has ruled that a government requirement for transgender people to be sterilized before they could be legally recognized was unconstitutional, in a victory for the country\u2019s LGBTQ community years in the making.
