A nominee for a district judgeship in Oklahoma struggled during her nomination hearing on Wednesday to define basic terms for orders issued regularly by judges.<\/p>\n
Sara E. Hill, who is nominated by President Biden to be the district judge for the Northern District of Oklahoma, was grilled by Sen. John Kennedy, R-La., on the Senate Judiciary Committee about basic legal and Constitutional terms and definitions \u2014 a practice that\u2019s become usual for him in recent months after several nominees have\u00a0struggled to pass\u00a0his tests.<\/p>\n
When Kennedy asked Hill the difference between a \u2018stay\u2019 order and an \u2018injunction\u2019 order \u2014 two orders frequently issued by federal courts \u2014 Hill stumbled through her answers.\u00a0<\/p>\n
\u2018A stay order would prohibit, um, sorry. An injunction would restrain the parties from taking action. A stay order \u2026 I\u2019m not sure I can, actually can, can give you that,\u2019 she said.<\/p>\n
An injunction is\u00a0an order from the court that prohibits a party in a case from performing or ordering a specified act as the case continues, either temporarily or permanently, sometimes referred to as a temporary restraining order.<\/p>\n
A stay order\u00a0is issued to stop the legal proceedings of a case in court.<\/p>\n
Carrie Severino, constitutional lawyer and president of the Judicial Crisis Network, commented on X (formerly Twitter) about the exchange by saying, \u2018How can an individual who wants to be a federal judge possibly not know this?\u2019<\/p>\n
\u2018Stays and injunctions come before district judges all of the time. This is not a trick question,\u2019 she added.<\/p>\n
Severino noted that at the end of Kennedy\u2019s probe, committee Chair Sen. Dick Durbin, D-Ill., \u2018even congratulated Hill afterward for \u2018passing the Kennedy bar exam\u2019 \u2013 talk about grading on a curve!\u2019<\/p>\n\n
