{"id":12784,"date":"2023-12-13T03:59:31","date_gmt":"2023-12-13T03:59:31","guid":{"rendered":"https:\/\/shareperformanceinsight.com\/index.php\/2023\/12\/13\/special-counsel-jack-smith-to-use-data-from-trumps-phone-in-election-interference-trial-court-filing\/"},"modified":"2023-12-13T03:59:31","modified_gmt":"2023-12-13T03:59:31","slug":"special-counsel-jack-smith-to-use-data-from-trumps-phone-in-election-interference-trial-court-filing","status":"publish","type":"post","link":"https:\/\/shareperformanceinsight.com\/index.php\/2023\/12\/13\/special-counsel-jack-smith-to-use-data-from-trumps-phone-in-election-interference-trial-court-filing\/","title":{"rendered":"Special Counsel Jack Smith to use data from Trump\u2019s phone in election interference trial: Court filing"},"content":{"rendered":"<p class=\"speakable\">Special Counsel Jack Smith plans to use data from the cell phone former President Trump used in his final weeks in office\u2014including data revealing when Trump\u2019s phone was \u2018unlocked and the Twitter application was open\u2019 on Jan. 6, 2021, according to a new court filing.\u00a0<\/p>\n<p class=\"speakable\">Smith, in a filing Monday, notified the court that he plans to call \u2018expert\u2019 witnesses to testify in the trial against Trump, the 2024 GOP presidential frontrunner, which is set to begin March 4\u2013a day before Super Tuesday.\u00a0<\/p>\n<p>One of the experts Smith plans to call has \u2018knowledge, skill, experience, training, and education beyond the ordinary lay person regarding the analysis of cellular phone data, including the use of Twitter and other applications on cell phones.\u2019<\/p>\n<p>In the filing, Smith hints that an expert will be able to testify that he or she \u2018extracted and processed data from the White House cell phones\u2019 used by Trump and one other individual. The identity of that individual is unclear.<\/p>\n<p>Smith said the expert will also testify that they \u2018reviewed and analyzed data\u2019 on Trump\u2019s phone and on \u2018Individual 1\u2019s\u2019 phone, \u2018including analyzing images found on the phones and websites visited.\u2019<\/p>\n<p>Smith said the expert has \u2018determined the usage of these phones throughout the post-election period, including on and around January 6, 2021\u2019 and has \u2018specifically identified the periods of time during which the defendant\u2019s phone was unlocked and the Twitter application was open on January 6.\u2019<\/p>\n<p>Trump, in August, pleaded not guilty in federal court to all four federal charges stemming from Smith\u2019s investigation into 2020 election interference and the Capitol riot on Jan. 6, 2021.<\/p>\n<p>Trump is charged with\u00a0conspiracy to defraud the United States, conspiracy to obstruct an official proceeding, obstruction of and attempt to obstruct an official proceeding and conspiracy against rights.<\/p>\n<p>The cell phone data Smith plans to use in the trial is in addition to Trump\u2019s direct messages on the social media platform once known as Twitter, despite the company\u2019s efforts to block access.<\/p>\n<p>Unsealed court filings in August showed that\u00a0Smith\u2019s team obtained\u00a0location data and draft tweets in addition to the former president\u2019s messages.<\/p>\n<p>Attorneys for the company, now named X Corp., attempted to block and delay the effort in January and February, however, leading one federal judge to speculate that X owner and one-time CEO Elon Musk was attempting to ally himself with Trump.<\/p>\n<p>The social media giant ultimately lost the struggle, however, and was forced to hand over an extensive list of data related to the \u2018@realdonaldtrump\u2019 account, including all tweets \u2018created, drafted, favorited\/liked, or retweeted.\u2019<\/p>\n<p>The handover also included searches on the platform surrounding the\u00a02020 election, devices used to log into the account, IP addresses used to log into the account, and a list of associated accounts.<\/p>\n<p>Meanwhile, Smith on Monday asked the Supreme Court to rule on whether former President Donald Trump can be prosecuted on charges relating to his efforts to overturn the 2020 election results.<\/p>\n<p>A federal judge ruled the case could go forward, but Trump said he would ask the federal appeals court in Washington to reverse that outcome. Smith is attempting to bypass the appeals court \u2013 the usual next step in the process \u2013 and have the Supreme Court take up the matter directly.<\/p>\n<p>The Supreme Court, late Monday, asked Trump\u2019s lawyers to respond to the special counsel\u2019s motion by next Wednesday, December 20 \u2013 two days later than Smith had requested.\u00a0<\/p>\n<p>The Court\u2019s next scheduled conference day for consideration of such matters is Jan. 5, 2024.
