Special Counsel Robert Hur described President Biden as a \u2018sympathetic, well-meaning, elderly man with a poor memory,\u2019 and said he would bring no criminal charges against the president after a months-long investigation into his improper retention of classified documents related to national security.\u00a0<\/p>\n

Hur\u2019s report was made public Thursday afternoon.\u00a0<\/p>\n

Hur has been investigating Biden\u2019s improper retention of classified records since last year. Those records included classified documents about military and foreign policy in Afghanistan, among other records related to national security and foreign policy which Hur said implicated \u2018sensitive intelligence sources and methods.\u2019\u00a0<\/p>\n

\u2018We conclude that no criminal charges are warranted in this matter,\u2019 the report states. \u2018We would reach the same conclusion even if the Department of Justice policy did not foreclose criminal charges against a sitting president.\u2019<\/p>\n

But Hur, in the report, said the special counsel\u2019s team \u2018also considered that, at trial, Mr. Biden would likely present himself to a jury, as he did during our interview of him, as a sympathetic, well-meaning, elderly man with a poor memory.\u2019\u00a0<\/p>\n

\u2018Based on our direct interactions with and observations of him, he is someone from whom many jurors will want to identify reasonable doubt,\u2019 the report states. \u2018It would be difficult to convince a jury that they should convict him\u2014by then a former president well into his eighties\u2014of a serious felony that requires a mental state of willfulness.\u2019<\/p>\n

Biden\u2019s \u2018memory also appeared to have significant limitations\u2019 according to the report, and during conversations with his ghostwriter, recorded in 2017, his conversations were \u2018painfully slow, with Mr. Biden struggling to remember events and straining at times to read and relay his own notebook entries\u2019<\/p>\n

Hur\u2019s report pointed out that Biden\u2019s memory was \u2018worse\u2019 during an interview with the Special Counsel\u2019s office.<\/p>\n

During the interview, Biden \u2018did not remember when he was vice president, forgetting on the first day of the interview when his term ended (\u2018if it was 2013 \u2013 when did I stop being Vice President?\u2019), and forgetting on the second day of the interview when his term began (\u2018in 2009, am I still Vice President?\u2019)\u2019\u00a0<\/p>\n

\u2018He did not remember, even within several years, when his son Beau died. And his memory appeared hazy when describing the Afghanistan debate that was once so important to him. Among other things, he mistakenly said he \u2018had a real difference\u2019 of opinion with General Karl Eikenberry, when, in fact, Eikenberry was an ally whom Mr. Eiden cited approvingly in his Thanksgiving memo to President Obama,\u2019 Hur\u2019s report said.<\/p>\n
