{"id":15662,"date":"2024-02-16T12:49:15","date_gmt":"2024-02-16T12:49:15","guid":{"rendered":"https:\/\/shareperformanceinsight.com\/index.php\/2024\/02\/16\/doj-defends-special-counsel-report-on-bidens-memory-consistent-with-legal-requirement-not-gratuitous\/"},"modified":"2024-02-16T12:49:15","modified_gmt":"2024-02-16T12:49:15","slug":"doj-defends-special-counsel-report-on-bidens-memory-consistent-with-legal-requirement-not-gratuitous","status":"publish","type":"post","link":"https:\/\/shareperformanceinsight.com\/index.php\/2024\/02\/16\/doj-defends-special-counsel-report-on-bidens-memory-consistent-with-legal-requirement-not-gratuitous\/","title":{"rendered":"DOJ defends Special Counsel report on Biden\u2019s memory: \u2018Consistent with legal requirement,\u2019 not \u2018gratuitous\u2019"},"content":{"rendered":"<div>\n<p class=\"speakable\">The Justice Department defended Special Counsel Robert Hur\u2019s report on President Biden saying it was \u2018consistent with legal requirements and Department policy\u2019 after the White House sent a pointed letter to the agency.<\/p>\n<p class=\"speakable\">In the letter, obtained by Fox News, Associate Deputy Attorney General Bradley Weinsheimer defended the Hur report and its release to the public as being \u2018consistent\u2019 with the DOJ\u2019s policy, and its legal requirements.<\/p>\n<p>\u2018Having carefully considered your arguments, the Department concludes that the report as submitted to the Attorney General, and its release, are consistent with legal requirements and Department policy,\u2019 the letter, which was sent to White House Counsel Ed Siskel and Personal Counsel to Joe Biden Bob Bauer, said.<\/p>\n<div>\n<div class=\"pdf-container\"><\/div>\n<\/div>\n<p>Weinsheimer noted that the fall-out surrounding the release of Hur\u2019s report on the president\u2019s memory was not \u2018gratuitous\u2019 or \u2018unduly prejudicial.\u2019<\/p>\n<p>\u2018The identified language is neither gratuitous nor unduly prejudicial because it is not offered to criticize or demean the President,\u2019 the letter noted. \u2018Rather, it is offered to explain Special Counsel Hur\u2019s conclusions about the President\u2019s state of mind in possessing and retaining classified information.\u2019<\/p>\n<p>The associate deputy attorney general also pushed back against the White House\u2019s claims that the report \u2018inappropriately commented\u2019 on Biden\u2019s conduct with classified documents.<\/p>\n<p>\u2018Your claim that Special Counsel Hur inappropriately commented on uncharged conduct is misplaced,\u2019 Weinsheimer wrote. \u2018As an initial matter, as described above, rather than commenting on uncharged conduct, Special Counsel Hur was applying the evidence he gathered to the applicable law.\u2019<\/p>\n<p>\u2018Special Counsel Hur\u2019s report provides significant detail on the basis of his declination decisions. This includes factors that support his determination o f whether the President knew he possessed classified information and whether he acted willfully in possessing and retaining it,\u2019 he said.<\/p>\n<p>\u2018The language to which you object goes directly to these issues,\u2019 Weinsheimer said.<\/p>\n<p>Since Hur\u2019s report, which was released last Thursday, the White House has pushed back against the findings that characterized Biden as an \u2018elderly man with a poor memory.\u2019\u00a0<\/p>\n<p>Biden has also been vocal about the report\u2019s findings, lashing out that he \u2018did not remember, even within several years, when his son Beau died.\u2019<\/p>\n<p>\u2018How the h\u2014 dare he raise that,\u2019 Biden yelled during a press conference on Tuesday. \u2018Frankly, when I was asked the question, I thought to myself, it wasn\u2019t any of their d\u2014 business.\u2019<\/p>\n<p>Two sources later revealed to Fox News that it was Biden who brought up his son\u2019s 2015 death-not Hur.<\/p>\n<p>\u2018We conclude that no criminal charges are warranted in this matter,\u2019 the report, released Thursday, states. \u2018We would reach the same conclusion even if the Department of Justice policy did not foreclose criminal charges against a sitting president.\u2019<\/p>\n<p>The White House and the Department of Justice did not immediately respond to Fox News Digital\u2019s request for comment.<\/p>\n<p>Fox News\u2019 David Spunt and Jake Gibson contributed to this report.<\/p>\n\n<div>This post appeared first on FOX NEWS<\/div>\n<\/div>","protected":false},"excerpt":{"rendered":"<p>The Justice Department defended Special Counsel Robert Hur\u2019s report on President Biden saying it was \u2018consistent with legal requirements and Department policy\u2019 after the White House sent a pointed letter to the agency.
