The Justice Department will not produce subpoenaed audio recordings of former Special Counsel Robert Hur\u2019s interview with President Biden to House Republicans, putting Attorney General Merrick Garland at risk of being held in contempt of Congress.\u00a0<\/p>\n
House Oversight Committee Chair James Comer, R-Ky., and House Judiciary Committee Chair Jim Jordan, R-Ohio, have threatened to hold Garland in contempt of Congress over the Justice Department\u2019s failure to produce the records. Last month, they set Monday, April 8, as the deadline for Garland to comply.\u00a0<\/p>\n
The Justice Department did meet the GOP-imposed deadline to respond but notified lawmakers it would not turn over the audio files of Hur\u2019s interview about Biden\u2019s alleged improper retention of classified documents from his time as a senator and vice president.<\/p>\n
\u2018The Department is concerned that the Committees\u2019 particular focus on continuing to demand information that is cumulative of information we already gave you \u2014 what the President and Mr. Hur\u2019s team said in the interview indicates that the Committees\u2019 interests may not be in receiving information in service of legitimate oversight or investigatory functions, but to serve political purposes that should have no role in the treatment of law enforcement files,\u2019 Assistant Attorney General Carlos Uriarte wrote in a letter to Jordan and Comer Monday.\u00a0<\/p>\n
The Justice Department did agree to turn over some other materials, such as a transcript of an interview with Mark Zwonitzer, Biden\u2019s ghostwriter.\u00a0<\/p>\n
But Comer and Jordan last month warned Garland that if he did not turn over the audio recordings, the \u2018committees will consider taking further action, such as the invocation of contempt of Congress proceedings.\u2019<\/p>\n
Comer and Jordan subpoenaed the Justice Department for a transcript of Hur\u2019s interview with Biden and audio recordings.\u00a0<\/p>\n
Just hours before Hur was scheduled to testify publicly last month, the DOJ produced for the committees two redacted transcripts of Hur\u2019s interviews with Biden.\u00a0<\/p>\n
The Justice Department did not, however, produce the audio recordings of the interviews. Comer and Jordan said the committees \u2018specifically prioritized\u2019 the production of those audio recordings.\u00a0<\/p>\n
\u2018The Biden Administration does not get to determine what Congress needs and does not need for its oversight of the executive branch. It\u2019s curious the Biden Administration is refusing to release the audio of President Biden\u2019s interview with the Special Counsel after releasing the transcript,\u2019 Comer said in a statement Monday evening. \u2018Why shouldn\u2019t the American people be able to hear the actual audio of his answers? The American people demand transparency from their leaders, not obstruction.\u2019\u00a0<\/p>\n
Comer said his committee will \u2018continue to work with the Judiciary Committee to obtain the information needed for our investigation of President Biden\u2019s willful retention of classified documents.\u2019\u00a0<\/p>\n
\u2018We will respond to the Justice Department soon,\u2019 he said.\u00a0<\/p>\n
Meanwhile, Comer and Jordan subpoenaed Mark Zwonitzer last month. The subpoena compels Zwonitzer to turn over all documents and communications with Biden or his staff related to his ghostwriting work on Biden\u2019s memoirs \u2018Promise Me, Dad\u2019 and \u2018Promises to Keep,\u2019 including emails, call logs and more.\u00a0<\/p>\n
The subpoena also compels Zwonitzer to turn over all contracts and agreements related to his work, along with audio recordings of interviews and conversations with Biden and transcripts of those conversations and interviews.\u00a0<\/p>\n
The president has said that he did not share classified information with Zwonitzer, but Hur\u2019s report states that Biden would \u2018read from his notebooks nearly verbatim, sometimes for an hour or more at a time,\u2019 and \u2018at least three times President Biden read classified notes from national security meetings\u2019 to Zwonitzer \u2018nearly verbatim.\u2019\u00a0<\/p>\n
Hur testified last month that Zwonitzer \u2018slid\u2019 files of audio recordings and transcripts of conversations with Biden \u2018into his recycle bin on his computer\u2019 upon learning that a special counsel had been appointed to investigate the matter.<\/p>\n
Jordan, during Hur\u2019s public hearing, asked whether the ghostwriter tried to \u2018destroy the evidence.\u2019\u00a0<\/p>\n
\u2018Correct,\u2019 Hur testified.<\/p>\n
Hur, who released his report to the public in February after months of investigation, did not recommend criminal charges against Biden for mishandling and retaining classified documents \u2014 and stated that he would not bring charges against Biden even if he were not in the Oval Office.\u00a0<\/p>\n
Those records included classified documents about military and foreign policy in Afghanistan and other countries, among other records related to national security and foreign policy, which Hur said implicated \u2018sensitive intelligence sources and methods.\u2019\u00a0<\/p>\n
Hur, in his report, described Biden as a \u2018sympathetic, well-meaning elderly man with a poor memory\u2019 \u2013 a description that has raised significant concerns for Biden\u2019s 2024 re-election campaign.<\/p>\n\n
