It ended up sowing further division"},"content":{"rendered":"<p class=\"paragraph inline-placeholder\">            A ferocious debate that has raged across social media, legal chambers, police stations and Scottish politics also played out on the streets of Edinburgh this weekend.    <\/p>\n<p class=\"paragraph inline-placeholder\">            Scotland\u2019s Hate Crime and Public Order Act came into force last week, a contentious law that expands existing legislation to include transgender identity as a protected characteristic from hate crimes.    <\/p>\n<p class=\"paragraph inline-placeholder\">            \u201cWe must remember why this Bill is so necessary, every day in Scotland around 18 hate crimes are committed,\u201d\u00a0Scottish First Minister \u2013 then Justice Secretary \u2013 Humza Yousaf\u00a0said\u00a0when the act was passed back in 2021, citing the government\u2019s\u00a0estimated figures\u00a0at the time.    <\/p>\n<p class=\"paragraph inline-placeholder\">            \u201cThrough the passing of this landmark Bill, Parliament has sent a strong and clear message to victims, perpetrators, communities and to wider society that offences motivated by prejudice will be treated seriously and will not be tolerated,\u201d he said.    <\/p>\n<p class=\"paragraph inline-placeholder\">            Supporters of the law believe it will provide much-needed protection for the marginalized and regularly vilified transgender community, while critics say it will stifle free speech and even threaten hard-won women\u2019s rights. The two sides are at loggerheads, online and offline.    <\/p>\n<p class=\"paragraph inline-placeholder\">            In the first week of the law\u2019s enactment, a feminist group, \u201cLet Women Speak,\u201d organized a rally against the legislation in Scotland\u2019s capital on Saturday. It was met by a counterprotest from a small band of transgender rights campaigners, Reuters video showed. The two sides were kept apart by metal barriers as they traded noisy insults, amid a heavy police presence.    <\/p>\n<p class=\"paragraph inline-placeholder\">            Yet the bill has come into force as issues\u00a0around transgender rights, and how they intersect with women\u2019s rights, are creating a complex set of problems for lawmakers, sports regulators and employers, among others.    <\/p>\n<p class=\"paragraph inline-placeholder\">            As the confrontation simmers, the debate has become intensely polarized and\u00a0drawn in public figures such as JK Rowling, Elon Musk and Joe Rogan, none of whom are strangers to weighing in on culture war touchpoints.    <\/p>\n<p class=\"paragraph inline-placeholder\">            So what does the law mean, and why has it sparked outcry?    <\/p>\n<h2 class=\"subheader\">    \u2018Stirring up hatred\u2019<\/h2>\n<p class=\"paragraph inline-placeholder\">            Before Scottish lawmakers passed the bill, laws already existed across the United Kingdom to criminalize \u201cstirring up hatred\u201d against racial identity. This new legislation introduces offenses for hate crimes against more characteristics, including age, disability, religion, sexual orientation, transgender identity and variations in sex characteristics.    <\/p>\n<p class=\"paragraph inline-placeholder\">            Biological sex, however, is not included. The government says this is because it\u00a0intends to put a\u00a0separate\u00a0bill criminalizing misogyny before the Scottish parliament at a later date.    <\/p>\n<p class=\"paragraph inline-placeholder\">            According to Susan Smith, however, the director of For Women Scotland, a gender-critical feminist campaign group, this creates an \u201cinequality\u201d within the law.    <\/p>\n<p class=\"paragraph inline-placeholder\">            Another major concern for those who oppose the Hate Crime Act is the supposed lack of clarity on what type of behavior could constitute an offense under the new law. Section three makes it an offense to behave in a manner\u00a0or communicate material \u201cthat a reasonable person would consider to be threatening or abusive\u201d with the intention of stirring up hatred.    <\/p>\n<p class=\"paragraph inline-placeholder\">            \u201cThe test for \u2018threatening\u2019 is obviously much, much higher than the test for \u2018abusive,\u2019\u201d Smith said. \u201cWhat somebody sees as abusive varies from person to person.\u201d    <\/p>\n<p class=\"paragraph inline-placeholder\">            Those convicted under the new law could face up to seven years in prison, and\/or a fine.    <\/p>\n<h2 class=\"subheader\">    Online arena<\/h2>\n<p class=\"paragraph inline-placeholder\">            Complicating the implementation of the law, Siobhan Brown, Scotland\u2019s Minister for Victims and Community Safety, sparked confusion about whether or not the act would make misgendering someone online a crime.    <\/p>\n<p class=\"paragraph inline-placeholder\">            It was at this juncture that Rowling \u2013 the\u00a0<em>Harry Potter<\/em>\u00a0author turned strident gender-critical commentator \u2013 deliberately<strong>\u00a0<\/strong>misgendered several<strong>\u00a0<\/strong>trans women online and dared police to arrest her.    <\/p>\n<p class=\"paragraph inline-placeholder\">            Police Scotland later confirmed it would not be investigating Rowling\u2019s posts as a criminal offense.    <\/p>\n<p class=\"paragraph inline-placeholder\">            First Minister\u00a0Yousaf told the BBC last Wednesday he was not \u201csurprised\u201d\u00a0that officers decided not to charge Rowling, despite her comments being \u201coffensive, upsetting and insulting to trans people.\u201d    <\/p>\n<p class=\"paragraph inline-placeholder\">            \u201cBut it doesn\u2019t mean that they meet a threshold of criminality of being threatening or abusive and intending to stir up hatred,\u201d he said.    <\/p>\n<p class=\"paragraph inline-placeholder\">            Vic Valentine, Scottish Trans Policy and Public Affairs officer at Equality Network, argues the law \u201cgets the balance right\u201d with free speech.    <\/p>\n<p class=\"paragraph inline-placeholder\">            But 25-year-old Scottish trans student Lucy (who asked not to be identified by her real name due to concerns about continued online abuse), said the new law does not reassure her.    <\/p>\n<p class=\"paragraph inline-placeholder\">            \u201cAbuse towards trans people is normalized and sometimes encouraged, so I don\u2019t see that changing regardless of what laws are introduced,\u201d she said, adding that abuse is \u201cpretty constant\u201d when using the social media platform X.    <\/p>\n<p class=\"paragraph inline-placeholder\">            This act is not the first time Scotland has moved out of alignment with the rest of the UK in an attempt to make transgender laws more progressive.    <\/p>\n<p class=\"paragraph inline-placeholder\">            In January, the British government\u00a0blocked\u00a0Scotland\u2019s attempt to reform the UK-wide Gender Recognition Act 2004, which allows people to apply to have their legal gender changed. Scotland\u2019s proposed reforms would have allowed transgender people to self-identify, without the need for a medical diagnosis or certificate.    <\/p>\n<p class=\"paragraph inline-placeholder\">            This episode only made things worse, according to Lucy. \u201cIf the self ID debate hadn\u2019t started, I don\u2019t think people would\u2019ve been swallowed up by most of the hateful rhetoric,\u201d she said. \u201cI think people will double down on whatever they have to say about trans people in light of the new law as some form of \u2018protest.\u2019\u201d    <\/p>\n<h2 class=\"subheader\">    \u2018Vexatious\u2019 claims and misinformation<\/h2>\n<p class=\"paragraph inline-placeholder\">            The Scottish Police Federation has repeatedly raised concerns about the capacity of officers to deal with a potential surge in hate crime complaints,\u00a0suggesting\u00a0on X Sunday that they had been \u201cswamped.\u201d    <\/p>\n<p class=\"paragraph inline-placeholder\">            Police Scotland received 7,152 complaints under the new legislation in its first week of operation, the UK\u2019s PA Media news agency reported on Wednesday. The force announced it had officially recorded complaints of 240 hate crimes and 30 non-hate crime incidents.    <\/p>\n<p class=\"paragraph inline-placeholder\">            In a Saturday\u00a0op-ed\u00a0for Scottish newspaper\u00a0<em>The Courier<\/em>, Yousaf wrote that, \u201ccritics of this law shouldn\u2019t exaggerate its impact with false fears.\u201d Later that day he told PA Media that \u201cdeliberate misinformation\u201d is being \u201cpeddled by some bad actors.\u201d    <\/p>\n<p class=\"paragraph inline-placeholder\">            Escalating an already volatile debate, Scotland\u2019s new law has become an obvious flashpoint in online culture wars, with global public figures drawing attention to it on their platforms.    <\/p>\n<p class=\"paragraph inline-placeholder\">            Last month, Police Scotland were forced to release a\u00a0statement\u00a0denying that officers had been instructed under the Act \u201cto target actors, comedians, or any other people or groups,\u201d after such claims were spearheaded by influential US podcast host Joe Rogan and billionaire X CEO Elon Musk.    <\/p>\n<p class=\"paragraph inline-placeholder\">            On March 19, Musk\u00a0reposted\u00a0comments from Malaysian far right commentator and social media influencer Ian Miles Cheong who said police officers in Scotland had been given training to \u201ctarget\u201d social media posts with material deemed \u201cthreatening and abusive.\u201d    <\/p>\n<p class=\"paragraph inline-placeholder\">            Musk reposted it on X, calling it \u201can example of why it is so important to preserve freedom of speech.\u201d In its statement, however, Police Scotland addressed this as \u201cinaccurate media reporting and commentary.\u201d    <\/p>\n<p class=\"paragraph inline-placeholder\">            Among those actually affected by Scotland\u2019s new law, such as Lucy, not everyone is willing to be as vocal \u2013 despite being on the frontlines of this confrontation.    <\/p>\n\n<div>This post appeared first on cnn.com<\/div>","protected":false},"excerpt":{"rendered":"<p>A ferocious debate that has raged across social media, legal chambers, police stations and Scottish politics also played out on the streets of Edinburgh this weekend.
