{"id":20139,"date":"2024-06-24T11:47:42","date_gmt":"2024-06-24T11:47:42","guid":{"rendered":"https:\/\/shareperformanceinsight.com\/index.php\/2024\/06\/24\/trumps-legal-team-back-in-court-in-florida-classified-documents-case\/"},"modified":"2024-06-24T11:47:42","modified_gmt":"2024-06-24T11:47:42","slug":"trumps-legal-team-back-in-court-in-florida-classified-documents-case","status":"publish","type":"post","link":"https:\/\/shareperformanceinsight.com\/index.php\/2024\/06\/24\/trumps-legal-team-back-in-court-in-florida-classified-documents-case\/","title":{"rendered":"Trump\u2019s legal team back in court in Florida classified documents case"},"content":{"rendered":"<div class=\"paywall has-gated-overlay gated-article-body\">\n<p class=\"speakable\">Former President Trump\u2019s legal team is back in court on Monday after a Friday hearing in which both sides argued the legality of Special Counsel Jack Smith\u2019s appointment in the classified document case against the former president.<\/p>\n<p class=\"speakable\">The hearing continues Monday when the two sides again discuss matters related to Smith\u2019s appointment as well as a limited gag order that prosecutors have requested to bar Trump from comments they fear could endanger the safety of FBI agents and other law enforcement officials involved in the case.<\/p>\n<p>Trump\u2019s lawyers have said any speech restrictions would infringe on his free speech rights. Cannon initially rejected the prosecution\u2019s request on technical grounds, saying Smith\u2019s team had not sufficiently conferred with defense lawyers before seeking the restrictions. Prosecutors subsequently renewed the request.<\/p>\n<p>U.S. District Judge Aileen Cannon heard hours of arguments Friday from lawyers for both sides, with Trump attorney Emil Bove asserting that the Justice Department risked creating a \u2018shadow government\u2019 through the appointment of special counsels to prosecute select criminal cases.<\/p>\n<p>Bove mentioned the term \u2018shadow government\u2019 while describing a situation in which inferior officers, unconfirmed by the Senate, are put in power.<\/p>\n<p>\u2018These are the risks we are running,\u2019 he said.<\/p>\n<p>Prosecutors said there was nothing improper or unusual about Smith\u2019s appointment, with James Pearce, a member of Smith\u2019s team, at one point saying, \u2018We are in compliance. We have complied with all of the department\u2019s policies.\u2019<\/p>\n<p>Cannon did not make a decision on Friday and is expected to issue a written order on the matter in the coming days.<\/p>\n<p>On Tuesday, Trump\u2019s team is expected to argue in another hearing that the search of Trump\u2019s Mar-a-Lago home in Palm Beach, Florida, on Aug. 8, 2022, that turned up the classified documents was illegal and all the evidence found in the search should be thrown out. Trump\u2019s team will also argue that the search could have been done informally with Trump\u2019s consent.<\/p>\n<p>Trump faces charges stemming from Smith\u2019s investigation into his possession of classified materials.
